Can a dependent apply for the UK ILR?

A dependent can apply for an Indefinite Leave to Remain (ILR) in the UK, provided they have lived there for five years. They must have resided in the UK with a UK family visa or as a dependent with an eligible work visa. You can apply for a UK spouse visa or UK child dependent visa if your spouse or parent is already living in the UK and has an Indefinite Leave to Remain (ILR) status. Dependent spouses, children, adult-dependent relatives, children above 18, dependent parents, etc., are eligible to apply for an ILR in the UK.

ILR Eligibility Requirements for Dependent Partner

The eligibility requirements for Dependent Partners to apply for UK ILR are as follows:

 

  • Have resided with the primary applicant in the UK for 5 years on a Dependent visa
  • Are still related to the primary applicant, and the couple plans on living together
  • Have not been absent from the UK for more than 180 days in  any 12 months

 

ILR Eligibility Requirements for Children

The eligibility criteria for children under 18 years of age are as follows:

 

  • Have a Dependent visa
  • You are applying for the ILR at the same time as your parents
  • You are unmarried and not involved in a civil partnership
  • Will continue living with the primary applicant.

 

Note: Both the parents must be settled enough for the child to be eligible

 

  • Children over 16 years of age must submit documents to prove that they are:
  • Still financially dependent on the primary applicant
  • Not leading an independent life
  • Currently living with the primary applicant

The eligibility criteria for children born in the UK are as follows:

 

Before parents are granted an Indefinite Leave to Remain (ILR)

You can apply to register the child born in the UK as a British citizen if one or both parents have been granted the ILR status. Upon successfully processing the application, you can apply for a British passport.

 

After parents are issued an ILR

After one or both parents are issued an Indefinite Leave to Remain (ILR), children born in the UK will automatically gain British citizenship. You can then apply for a British passport.
