Foreign teachers who have an employment contract for a job role that falls under the speciality or skilled occupation can apply for an H-1B visa. This visa permits U.S. schools to sponsor their foreign employees by filing an H-1B visa petition on behalf of their foreign employees. People who are applying for this visa should meet the educational requirements for the job role and need to get a professional licence. The employer has to get an approval from LCA and authorization from Department of Labor. Teachers can work in the US for up to six years under this visa.

USCIS accepts additional petitions under the cap-exempt category apart from their annual 85,000 intake. The petition falls under the cap-exempted category if the applicant is working for a:

After submitting the application, the visa is sent for processing. On average, the processing time for an H-1 B visa is 3-5 months.
