How does a partner visa work in Australia?

An Australia Partner Visa allows married or de facto partners of Australian Citizens or PR holders to migrate and settle in Australia as permanent residents. The country offers two types of partner visas- Subclass 820 (Temporary visa for partners) and Subclass 801 (Permanent Visa for partners). Candidates willing to settle in Australia as permanent residents can apply for the Subclass 801 visa. While the application is being processed, the Subclass 820 visa will allow them to stay in Australia as a legal temporary resident.
 

Who can apply for an Australia Partner Visa?

Spouses or de facto partners of Australian PR holders, Australian citizens, or New Zealand citizens can apply for the Australia Partner Visa (Subclass 820 and 801), provided they meet the requirements mentioned below:
 

  • Must be above 18 years of age
  • Must be in a genuine relationship with substantial and verifiable proof
  • Must be medically fit
  • Must have zero criminal records
  • Must show enough funds to support yourself and your spouse or partner
  • Must be sponsored by your spouse or partner who holds citizenship or permanent residence in Australia
     

Note: You can apply for a Subclass 801 visa (permanent visa for partners) only after having a Subclass 820 (Temporary Visa for Partners).
 

How to apply for an Australia Partner Visa?

The steps to apply for an Australia Partner Visa (Subclass 820 and 801) are detailed below:

Step 1: Create an ImmiAccount

Step 2: Lodge an application form while your sponsor lodges a sponsorship form

Step 3: Gather and arrange the documents required

Step 4: Apply for the visa

Step 5: Receive a Subclass 820 visa or a bridging visa (depending upon your residency status)

Step 6: Wait for your Subclass 801 visa to be approved

Step 7: Migrate to Australia
 

Journey to Australia Partner Visa Application Steps

The sponsor and the beneficiary must be in Australia while lodging the Partner Visa application. Once the application is lodged, the applicant can enter and exit Australia as many times as they want. It usually takes around 8-26 months to process the Subclass 801 Visa application, and once approved, it allows you to stay in Australia permanently.
