What are the new ILR rules?

The UK Government recently announced major changes to the Long Residence route for UK ILR. The Long Residence pathway allows individuals residing in the UK for ten consecutive years or more to apply for an ILR. With an Indefinite Leave to Remain, individuals can live in the country indefinitely and even become eligible for British citizenship. The basic criterion for an ILR is a continuous residency requirement, with 10 years being the stay period for the Long Residence route. In April 2024, the UK enforced a new Appendix Long Residence, with new ILR rules.

New 10-Year Long Residence ILR Rules 2024

The Appendix Long Residence Route has new rules and changes for the UK’s 10-year-long residence pathway.

 

The new Indefinite Leave to Remain (ILR) rules in the UK are as follows:

 

  • An individual must have had permission on their present immigration route for a minimum of 12 months on the date of their application (If issued after April 11, 2024) or be exempt from immigration control for a minimum of 12 months before applying.
  • The above rule will not apply to applications issued before April 11, 2024.
  • Any absences from the UK that took place before April 11, 2024, should not exceed 184 days.
  • The 10-year period counted from before April 11, 2024, must not exceed absences of over 548 days, while applications with the 10-year period exceeding April 11, 2024, will not have the 548-day limit.
  • Starting April 11, 2024, individuals must not have stayed outside the UK for more than 180 days in any 12-month period.
  • Individuals who completed their 10-year period before April 11, 2024, cannot be absent from the country for more than 184 days at once or for more than 548 days in total.
