The USCIS has released a new version of the Form I-9 on 31st January 2020. Form I-9 is used to verify the employment eligibility of an applicant.
Certain employers in the US must use the Form I-9 to verify if the foreign worker they are hiring is legally authorized to work in the US or not. The employers must maintain a Form I-9 for each employee as long as the employee is working for the employer. Even if the employee is no longer employed with the employer, the Form I-9 must be maintained for a stipulated period of time.
It is mandatory for employers to maintain complete and proper Form I-9s. If they do not do so, they may face criminal or monetary penalties.
The USCIS publishes an online Form I-9 as well as a paper Form I-9. The US has updated the new online Form I-9 to reflect new countries of issuance. Also, the USCIS has updated the instructions of the Form I-9 to provide more clarity on authorized representation. The instructions also provide information on required documents and other non-material updates.
The new paper Form I-9 has no new changes compared to the older version.
The employer is allowed to designate anyone to act as an authorized representative on their behalf to complete Section 2 of the Form I-9. However, the employer will be held responsible for any violations by the authorized representatives and may face monetary and criminal penalties.
All employers must use the new Form I-9 on or after 30th April 2020. Using an older version of the Form I-9 after 30th April may attract penalties.
Employees who have already been verified and have a completed Form I-9 need not be reverified. Unnecessary re-verification could possibly break anti-discrimination laws and may attract civil and criminal penalties for the employer.
