US immigration bill delayed amid rejection fears

Biden’s US immigration bill has been delayed amid fears of being rejected, as per sources.

The Republicans have been alleging that the bill might encourage an immigrant surge. House Democrats have postponed a vote on the US President’s bill following a whip count revealing that it could be rejected.

Biden’s proposed immigration overhaul entails illegal immigrants in the US being allowed a 5-year period of “temporary legal status”, to be followed up by 3 years with a US Green Card. After the completion of this period, the individual would be able to apply for US citizenship.   This could prove to be a pathway for US citizenship for an estimated 11 million undocumented immigrants in the US.   A supermajority vote of 60 is required for most legislations to be passed in the evenly-divided Senate.

Rather than voting on the Biden US immigration bill, many Democrats will be turning their attention instead to other smaller bills that they deem to be “less ambitious”.

In mid-March, votes on 2 smaller bills might take place in the US Senate.

The House of Representatives has delayed a vote on President Biden’s largest immigration reform bill.   The postponement came after House Speaker Nancy Pelosi determined that there might not be enough votes to pass the bill.   The legislation was previously scheduled to go to the House floor in March for being voted upon.

Nevertheless, votes on 2 comparatively narrower immigration bills will be moved this month. These are –

  • The Farm Workforce Modernization Act, creating a pathway for the legalization of current unauthorized agricultural workers, and
  • The American Dream and Promise Act, providing certain individuals in the US protection from deportation as well as a way of obtaining legal status in the US.

On February 18, 2021, Senator Robert Menendez and Representative Linda Sanchez formally introduced a new immigration bill – the US Citizenship Act of 2021.

It was on his first day in office that US President Joseph Biden released a fact sheet putting down his intention of sending in a comprehensive immigration bill to the Congress with the aim of restoring “humanity and American values” to the US Immigration system.

It is the US Citizenship Act of 2021 that is regarded to be the medium for achieving this.

The proposed legislation aims to execute on various campaign promises by Biden, including that of providing pathways to US citizenship for certain undocumented individuals, along with streamlining multiple employment-based programs for non-immigrant and immigrant visas.

There are many changes foreseen in this legislation that might impact the ability of US employers to hire and retain foreign talent.
