Canada Open Work Permit for US H-1B Visa Holders

Immigration officials in Canada announced that more H-1B open work permit applications will be processed this week. The applications are selected using a temporary measure announced in July last year. IRCC will not select new applications that are submitted under this measure. This temporary measure is Canada’s first-ever immigration Tech Talent Strategy that targets temporary workers in the tech sector in the United States.

Tech Talent Strategy

Canada launched an immigration Tech Talent Strategy on July 16 last year. This strategy intended to fill Canadian jobs with qualified employees from the United States. Canada targets newcomers to help enshrine Canada as a world leader in many emerging technologies. This strategy provides open work permits for foreign nationals working in the United States with H-1B visas. Also, this strategy provides work and study permit options for the family members of workers.

 

Immigration Minister Sean Fraser said, “We’re eager about the progressive goals we have set in immigration because they aren’t just about numbers. They are strategic.” IRCC had received 10,000 applications within one day.

New temporary public policy

The new temporary public policy announced on March 18 removes the processing fees for minor children of H-1B holders who have applied for Canada open work permits under the H-1B work permit measure. IRCC states this policy will help the H-1B applicants who could not submit a study permit application for their minor children.

 

Under the new public policy, the IRCC will process:

 

IRCC will process applications that are listed below:

  • Applications received on July 17 last year will be processed.
  • Applications that were submitted through the Authorized Paid Representatives Portal on July 17th.
  • Work permit applications of accompanying family members.
  • Family members of applicants who have already applied for a work permit or will apply in the next 12 months.
