The Department of Labor will soon launch its crackdown on the US Work Visa fraud. Employers in the US reliant on overseas work visas for staffing their firms should expect enhanced scrutiny. This was revealed by a senior official of the Department of Labor.
The DOL will launch its campaign against employers who violate the law. Its focus will be on those who would have committed US Work Visa Fraud. The Visa programs under review include seasonal workers in the farming sector and others. This also includes highly specialized workers, as quoted by the Bloomberg Law.
The firms that violate the law will now be subject to a streamlined process for suspension. They could also be debarred from obtaining work visas. The process of auditing visa applications will be made more stringent and speedier.
The scope of DOL will expand with respect to punishing erring employers. They would be penalized for misconduct such as misrepresentation of work type of employees in the application. It would also be applicable for improper payment to workers.
Office of Federal Contract Compliance Programs of the DOL recently concluded that US workers were discriminated against Cisco Systems Inc. This is by favoring migrant visa holders for US Job Openings. The firm used H-1B Visas for hiring 1000 plus overseas workers.
The campaign against US Work Visa fraud is among the measures by the DOL for scrutinizing the overseas worker visa programs. It is involved with other agencies in immigration process tasked with identifying ways to ensure US nationals are prioritized over overseas workers. This stipulation is included in the executive order of President Trump to Hire American and Buy American.
