Business or Tourist Visa Holders in the US

People holding business and tourist visas can now apply for new jobs in the US. One can even appear for interviews for prospective employment with the same visa.

 

However, the US Citizenship and Immigration Services (USCIS) have asked that the employees must only change their visa status before starting to work.

USCIS on non-immigrant workers

The USCIS has recently tweeted that when non-immigrant workers are laid off, they must leave the country within 60 days of termination of employment. And they may not even realize that they have options, and sometimes they know that they don't have any other option except leaving the country.

 

What can a nonimmigrant worker do in the US after termination?

  • After a nonimmigrant worker is terminated (voluntary or involuntary), they can remain in a period of authorized stay in the US (if eligible) by taking any one of the following actions:
  • Apply for a change of nonimmigrant status; or
  • Apply for the adjustment of status; or
  • Apply for "compelling circumstances"; or
  • Become the beneficiary of a nonfrivolous petition to change employer.
