The H-1B Visa Premium Processing has now started from 10th June as announced by the United States Citizenship and Immigration Services. This will now include all the outstanding H-1B cap petitions, it added.
The USCIS had earlier announced in March that the H-1B Visa Premium Processing will be offered in 2 phases. This is for better management of these petitions, it had added, as quoted by the Times of India.
The Phase-1 for premium processing had commenced on 1 April 2019. It included all the H-1B cap petitions for FY 2020 that requested a status change. This included overseas students with F-1 Visas working under OPT - Optional Training Program. It was for those whom employers had sponsored for US Work Visas under the H-1B program.
The Phase-2 was scheduled to commence in June and has accordingly stated from 10th June. From this date sponsoring employers in the US can avail premium processing for a fee of $1,410. This is if they have submitted H-1B petitions that did not involve a status change. The applications are adjudicated in 15 days through the premium processing.
Y-Axis Immigration Expert Vasanta Jaganatan elaborated on the process. The 15-day calculation begins after the form requesting premium processing the I-907 is received by the USCIS, said Ms. Jaganatan. The USCIS has to either issue an RFE - Request for Evidence or approve the petition within days, she added.
If RFE is issued by the USCIS, the 15-day calculation starts once it receives the data asked for under the RFE said the Immigration Expert.
The FY 2020 will permit successful H-1B Visa applicants to work in the US at the most from 1 October 2019. USCIS had received 2.01 lakh applications for the annual allocation of 85,000 Visas. 20,000 out of these are set aside for Master’s quota for those with qualifications from US Universities. This overflow necessitates section randomly through the lottery.
The premium processing is a relief for the overseas workers who will come from outside the US. They will have adequate time to litigate or appeal against it prior to the 1 October start date if the application is rejected.
The H-1B cap applications for FY 2019 were filed in April 2018. The USICS had extremely delayed the premium processing and opened it up in phases only from 28 January 2019. This resulted in several challenges for sponsoring employers in the US.
