A Judge of Superior Court in Quebec has ordered that the processing of 18,000 backlogged QSWP applications must continue. The Provincial Government had proposed to cancel all the pending 18,000 applications to clear the backlog.
Justice Frédéric Bachand of the Superior Court in Quebec offered a provisional injunction. This was while responding to the arguments by a group of Immigration Lawyers in Quebec. These argued that the dismissing of all the 18,000 QSWP applications was fully unlawful. It would also have shocking consequences for the applicants who are affected by this they added.
The Quebec Government had proposed dismissing all QSWP applications that were filed prior to 2 August 2018. This was through legislation called Bill 9 tabled on 7 February. It also added that the order for termination of applications would be effective immediately, as quoted by the CIC News.
Simon Jolin-Barrette the Immigration Minister of Quebec said that the government respects the ruling of the Court. The QSWP applications will be continued to be processed. This is till the time the National Assembly of Quebec passes the Bill 9 legislation as a law, he added.
Guillaume Cliche-Rivard Association québécoise des avocats et avocates en droit de l’immigration President said that this is a great new. It is great news for Quebec society as well added the AQAADI President.
The request for an injunction was made by AQAADI in the name of a nurse from South Korea Seeun Park. She had also filed an application for the Quebec Skilled Worker Program. It was one among the 18,000 applications affected by the latest proposal of the Government.
AQAADI has requested the Court that the QSWP applications be continued to be processed. This is for the CSQ by the Government and at a usual speed till the time Bill 9 gets passed as a law.
