The US advises that if you are planning to apply for an H1B Visa, you should do so 90 days in advance. You can apply 90 days before the job start date that is mentioned on your I-797 form. The US Embassy in India gave out this information through their Twitter account.
The USCIS issues various types of I-797 forms. These forms are used to communicate with applicants or let them know of an immigration benefit.
The H1B Visa is immensely popular among Indians, especially tech professionals. The US issues around 85,000 H1B Visas every year. It is estimated that 70% of all H1B Visas granted are issued to Indians.
There are no country caps on the H1B Visa at present. However, there have been reports that say that the Trump Govt. may place a country cap on H1B Visas in future. The US Govt. has denied any such report.
The Trump Govt. has been working on revising the US visa rules under the “Buy American Hire American” campaign.
The H1B Visa is a Work Visa that allows employers in the US to hire foreign workers in speciality occupations. These occupations generally need technical or theoretical expertise.
There were 580,000 non-resident Indians in the US in 2016. 440,000 of these were temporary foreign workers which also included those on the H1B Visa. 140,000 of the non-resident Indians were international students, as per LiveMint.
The Indian Govt. has complained to the US over the high H1B rejection rate and increased scrutiny for Indians.
