What are your options if Swedish Work Visa renewal is rejected?

The application for Swedish Work Visa renewal may be rejected by the concerned authorities sometimes. In this scenario, below are the options that are available:

Getting the decision

Normally, 2 letters from the Migration Agency will be sent to you on consecutive days regarding your decision. You should get in touch with at the earliest them if in case you have any questions about the information.

 

Talk to your company

The company that you are employed with will also be directly intimated regarding the decision. Nevertheless, you can cross-check the information for details. There could be errors while submitting or compiling the documents. If not, The MA could have erred during the assessment of your application, as quoted by the Local SE.

 

First appeal - Migration Agency

Appealing to the Migration Agency is the first step in challenging the decision. It will review your appeal, and may alter its original decision or stick to it. MA will forward your appeal to the Migration Court if it does not see any reason to alter the decision.

 

The Migration Court will then consider whether you must be permitted to remain in Sweden.

 

Second appeal - Migration Court of Appeal

You must appeal to the Migration Court of Appeal if the Migration Court rejects your appeal. On the other hand, this court does not consider each case. Thus, there is no assurance unfortunately that you will obtain this appeal.

 

The MCA takes up only those cases that are not guided by current laws. It also considers the case if there are no past rulings and there are chances of precedence setting.

 

Re-applying

If you exhaust all the above options after the rejection of Swedish Work Visa renewal, you will have to exit Sweden. You will be able to re-apply from overseas.
