Indians advised to apply 90 days before they start working in the U.S.

As per a recent advisory by the U.S. Embassy in New Delhi, Indian applicants have been directed to apply well in advance for their U.S. work visas.

In an October 9 Tweet, the U.S. Embassy in New Delhi has advised those applying for their “work #USvisa” to do so “up to 90 days before the employment start date” that is noted down on their individual I-797.

About 85,000 H1-B visas are issued each year.

Do keep in mind that I-797 is not a form to be filled up by you.

The U.S. Citizenship and Immigration Services (USCIS) uses different types of Form I-797 for the purposes of communication with petitioners and applicants or for conveying any immigration benefit that the applicant might be entitled to.

What is the application process for H-1B?

The employer must –

1. Fill up the Application Form. Form I-129, Petition for Non-Immigrant Worker is to be filled up.
2. Payment of Filing Fees. The relevant filing fees to be included, along with biometric services fees, if applicable.
3. Evidence submission. All supporting documentation and required evidence to be submitted.
4. Signing and Filing of Form I-129. The petition should be filed at the filing location as specified in the instructions with the form.

How long can I stay in the U.S. on H-1B visa?

Initially, you can stay for up to 3 years. Subsequent renewals can be made. Keep in mind that when considered with the renewals, your stay must not exceed a total of 6 years, with certain exceptions.

What happens after my Form I-129 is submitted?

Once your Form I-129 is received by the USCIS, the processing of your petition will commence.

Following which, both your employer and you will receive –

• Receipt Notice for your Form I-129.
• Notice for your biometric appointment date.
• Written notice of the decision taken on your petition.
