The US may tweak H1B and L1 Visa rules

The US may change H1B Visa rules to better protect American workers and wages.

The DHS (Dept. of Homeland Security) proposes to revise the definition of a “Specialty occupation”. This will be done to get the best and the brightest from across the globe through the H1B Program.

The new revisions have been proposed under the Fall 2019 Unified Agenda which is published by the White House Office of Management and Budget. The proposal may see additional requirements for the H1B Visa to ensure that visa holders are paid appropriately by employers.

Revision to visa rules has also been proposed for the L1 Visa. Additionally, the DHS also suggested that the H4 EAD work ban should be implemented by March 2020.

As per the DHS, the purpose of introducing these changes is to make sure that the H1B Visa is only awarded to those who meet the definition of a specialty occupation.Also, these changes will ensure that the H1B Program strengthens the American workforce and protects US workers.

For the H1B Visa, DHS has proposed the new rules to be effective by December 2019 and for the L1 Visa by September 2020.
