New Guidance on EB-1 Eligibility Criteria

The USCIS will update the Policy Manual to provide new guidance on the EB-1 eligibility criteria and clarify the type of documents that can be submitted as evidence of the applicants' extraordinary abilities.

 

The new policy guidance is willing to accept the following as evidence of extraordinary abilities:

 

  • An applicant’s team awards of excellence with national or international recognition
  • Past membership of the applicant under the membership criterion
  • Published material demonstrating the value of service provided by the applicant
  • Non-artistic exhibitions as a part of the properly supported claim of comparable evidence

 

The new policy update aims to clarify the details and provide transparency to petitioners so that they can submit appropriate evidence to demonstrate the applicant's eligibility. The new update overrules all prior updates released on this topic and will be implemented immediately.
