US Green Cards via marriage for immigrants are now eased

US Green Cards through marriage with US nationals have now been eased by the US Citizenship and Immigration Services. The USCIS has revised one of its procedures for the same for immigrants.

 

The immigrants who obtain the US Green Cards through marriage have them normally on a conditional basis. The validity of the cards is 2 years. After this period, those seeking PR must demonstrate that the marriage did not intend to violate immigration laws. Thus it is not deceitful as quoted by the Miami Herald.

 

The above process is known as an application to eliminate conditions on PR based on marriage. It requires Form I – 751. An interview with the office of the USCIS to show eligibility for removal of such conditions may also be needed.

 

The interviews make the couples anxious. This is because they are interrogated more often separately regarding intimate details of their lives. It is to assess the authenticity of their marriages.

 

However, a fresh Policy Memorandum has now been issued by the USCIS. It offers certain guidelines that can be used by its officials to determine the waiving of the interview.

 

USCIS has announced that adjudicators can now waive this crucial requirement if they contend that:
 

• Adequate proof regarding the marriage is available to establish its authenticity that it was not entered into for the purpose of evading immigration laws
• Fraud or misrepresentation is not indicated in Form I -751 or the supporting documents
• The main petitioner of Form I -751 has already been interviewed by the USCIS (Applicable for cases received after 10 December 2018)
• Any complex facts or issues are not present that need an interview for clarification
