• The USCIS has announced to publish an updated edition of Form I-129 from January 17, 2025.
• The updated I-129 Form is aligned with the H-1B modernization final rule and H-2 modernization final rule.
• The new I-129 form will replace the form which was released on April 01, 2024.
• The revised edition of I-129 form will have no grace period so that he USCIS can apply the final rules.

Revised I-129 Form to be released in 2025

The USCIS has recently announced that a revised edition of Form I-129 will be released on January 17, 2025. The updated I-129 petition for a non-immigrant worker is to be aligned with the recently released H-1B modernization final rule and H-2 modernization final rule.
 

The updated version of the I-129 Form will replace the form released on April 01, 2024, and no grace period will be allowed so that the USCIS can apply the final rules. From January 17, 2025, onwards, the USCIS will reject the petitions made using the old form.

Filing I-129 form on paper by mail

Candidates filing the I-129 form on paper by mail must note that:

• USCIS will accept the April 2024 version received before January 17, 2025.
• USCIS will reject the I-129 form if the candidate uses the old version on or after January 17, 2025.
• Candidates must use the updated version of the I-129 only after January 17, 2025.
