In a recent announcement, the USCIS declared that additional registrations will be held to reach the cap count for H-1B visa for FY 2025. The USCIS selects candidates randomly to reach the maximum number of registrations for FY 2025. All potential petitioners with selected registrations have been informed about the eligibility to apply for an H-1B cap subject petition on behalf of their beneficiary mentioned in the registration notice.
Petitions for H-1B Cap subject must be filled properly at the correct filing location and within the specified selection notice period. The minimum filing period for H-1B visa is 90 days. A copy of the selection notice should be attached with the FY 2025 H-1B cap subject petition. Petitioners must also comply with the eligibility criteria on the basis of the current regulatory and statutory and requirements.

The USCIS had published a new rule on the fee requirement for H-1B Visa on January 31, 2024. The new fee requirement is effective from April 01, 2024. Petitioners filing registrations must comply with the new fees to be considered for selection. They must also abide by the new Form I-129, Petition for a Non-immigrant Worker which was updated on January 04, 2024.
A final premium processing fee rule was announced on February 26, 2024 which raised the filing fee for Form I-907, Request for Premium Processing Service which also needs to be followed by the petitioners. Applications with incorrect filing fee might lead to rejection and the filing fee would be refunded.
