The Right of abode allows an applicant to work or live in the UK without needing a visa and without any limitation on the time they can reside in the country. The Right of abode is an immigration status to live freely in the UK without being subject to immigration controls. The Right of abode originates from the British Nationality Act 1948, which gives rights to eligible applicants with ties to the UK. This Right of Abode is eligible for some types of citizens:

  • British citizen
  • Certain British citizens
  • Citizens from Commonwealth Countries who, on 31 Dec 1982, had Right of Abode and have since remained a Commonwealth citizen
  • Married to someone with the right of abode

Eligibility criteria to apply for Right of Abode

  • Have a valid passport

  • Valid UK passport describing them as a British subject with the right of abode in the UK

Eligibility criteria to apply for the Right of Abode for commonwealth citizens through Parents

  • Have a parent who was born in the UK and a citizen of the UK and colonies where they have been born or adopted
  • Be a Commonwealth citizen on December 31, 1982
  • Did not stop being a commonwealth citizen after December 31, 1982
     

Eligibility criteria to apply for the Right of Abode for commonwealth citizens through Marriage

  • Been married to someone with the right of abode before January 1, 1983
  • Never stopped being a Commonwealth citizen, even temporarily, at any point on December 31, 1982
     

Requirements to apply for Right of Abode

  • Valid passport
  • Travel itinerary
  • Two passport-sized photographs
  • Certificate of entitlement
  • Birth certificate
  • Marriage certificate
  • Proof of citizenship in the UK
  • Specific evidence to show how an applicant can obtain the right of abode in the UK
     

Certificate of Entitlement

An eligible applicant can issue a Certificate of Entitlement in the passport or travel document of a person who qualified under the following:

  • Qualified as becoming a British citizen on or after January 1, 1983, and who has a certificate of entitlement to be inserted in a non-British passport
  • Commonwealth citizens who did not become British citizens on January 1, 1983, but remained right of abode before and after that date

Step 2: Fill out the application Form ROA to apply for a certificate of entitlement

Step 3:  Submit the requirements

Step 4: Wait for the response

Step 5: Once approved, travel in the UK without any restrictions
