Who needs an Employer-Specific Work Permit?

The closed work permit is particularly ideal for the below list of foreign workers:

  • Foreign workers who have applied for permanent residence through the RNIP (Rural and Northern Immigration Pilot) can apply for a work permit with a 12-month validity.
  • Foreign workers who have obtained provincial nomination
  • Foreign workers who have applied for permanent residence through the Atlantic Immigration Program. Individuals who have applied before March 5, 2022, will not require an LMIA, whereas those who apply after March 6, 2022, will require an LMIA.

 

What is LMIA for an Employer-Specific Work Permit?

LMIA, or the Labour Market Impact Assessment, is an official document issued by a Canadian employer before recruiting a foreign worker. Candidates looking to work in Canada must acquire a positive LMIA from the employer in Canada along with a valid employment contract. Having a positive LMIA indicates that the Canadian employer could not find a PR holder or citizen to fill the vacant job position.  
 

In cases where the Canada work permit is LMIA-exempt, the employer in Canada will be required to provide the foreign worker with an official employment number. The employment number will be released through the official employer portal. Successful Employer-specific work permit applications will receive the following:

  • LMIA-exemption code
  • Occupation title
  • Employment duration
  • Employer Name
  • NOC code

Eligibility Criteria for an Employer-Specific Work Permit

To be eligible for an employer-specific work permit, you must fulfill the below eligibility requirements are as follows:

  • A valid LMIA
  • Proof of employment or job contract in Canada
  • Employment number
