Aspiring overseas immigrants to the US must be aware of the new H-1B Visa rules that have been announced by the US administration. Below is a brief view of the same:
Sponsoring employers must register online prior to submitting applications for H-1B
The US DHS - Department of Homeland Security has declared a memo of a proposed law. It makes mandatory for the H-1B petitioners to first register with the USCIS online. This is during the period for designated registration. The rule may be delayed if a timely implementation is not possible.
Swapping of order for Master's cap lottery and regular lottery
Out of the 65,000 H-1B Visas for each fiscal year, first 20,000 petitions are filed for specific beneficiaries. These are the ones who possess a Masters or Doctorate Degree in the US and are cap exempt, as quoted by the Gadgets Now.
As per the proposed new H-1B Visa rules the USCIS intends to reverse the order for selecting H-1B petitions. This is under the capped quota and exemption for a higher degree. It is likely to enhance the prospects of selection for those with a Masters or higher degree in the US.
As of now, the advanced degree exemption and H-1B cap are both reached in the first 5 days itself. This is from April 1 to 5 every year. Currently, the advanced degree exempted selection is done prior to the capped quota for H-1B.
Complete H-1B applications to be lodged only if chosen in the lottery
It will assist in reducing the waiting time for notifications for cap selection. It is also proposed to limit the lodging of H-1B cap-subject applications to the recipient specified in the originally selected registration. This will safeguard the integrity of the registration system.
