As a US Overseas Student with the F-1 Visa, you are required to be aware of diverse aspects regarding your immigration status. Apart from this, another area with which you need to be familiar with is the Taxes. There are certain major aspects that you should be familiar along with the associated special tax provisions:

Overseas Students are US Non-resident Aliens:

US Overseas Students with the F-1 Visa are taxed in an identical manner similar to the US Non-resident Aliens for purposes of Federal Income Tax. They are required to fulfill other criteria that include substantial compliance with the visa requirements.

Only your US-source income is Taxable:

An overseas student will be taxed only for the FDAP US-source income, as quoted by the Study International. This is determinable or fixed periodic or annual income that is connected with a business or trade in the US. Another taxable head is ECI – income that is successfully associated with a business or trade in the US.

Exclusion from Medicare and Social Security taxes:

You may be immune from Medicare or Social Security taxes as an Overseas Student in the US. This is applicable if the overseas student performs a job in the US in accordance with the requirements of the F-1 Visa. For instance, below are the income sources that are exempt:

  • Student employment at the campus for maximum 20 hours weekly and 40 hours in summer vacations. For Ex: Working as a School Professor’s Research Assistant.
  • The United States Citizenship and Immigration Services permitted OPT - Optional Practical Training
